Draft Law on Energy and Regulation of Energy Activities established

The Government of the FBiH, at the proposal of the Federal Ministry of Energy, Mining and Industry, determined and sent to the parliamentary procedure the Draft Law on Energy and Regulation of Energy Activities. This law regulates the manner of determining and implementing energy policy and development planning, acts which determine and on the basis of which energy policy and energy development planning are implemented.
Also, the commitment to the use of renewable energy sources and the achievement of energy efficiency, the organization and functioning of the regulatory body and the basic issues of performing and regulating energy activities in the FBiH are determined.
The law also regulates issues of common interest for all energy activities or related to several forms of energy, while issues related to the sectors of electricity, natural gas, petroleum products, renewable energy sources and energy efficiency are regulated by special laws.
The FBiH Energy Policy includes several measures and measures taken to achieve long-term goals. These include reliable, secure and high-quality energy and energy supply, long-term balanced and sustainable development of the energy sector, and competitiveness in the energy market based on the principles of non-discrimination, publicity and transparency.
The goals are also the protection of end customers, the creation of conditions for investment in energy, the development of energy infrastructure and the introduction of modern technologies, the creation of conditions for the use of new energy sources. It is also about creating economic, economic and financial conditions for decarbonisation of the energy sector, production and consumption of energy from renewable sources and using efficient cogeneration, providing conditions for improving energy efficiency, improving environmental protection in all areas where energy activities are performed, as well as connecting the FBiH energy system with other energy systems.
As a reason for passing this law, the explanation states that the Federation of BiH does not have a law that would systematically regulate issues of common importance for the use of several forms of energy in the sectors of electricity, natural gas, petroleum products, renewable energy sources and energy efficiency.
Therefore, the adoption of a new legal framework is especially needed to legally define general and long-term goals of energy policy in the FBiH, as a starting point for the work of all competent authorities and entities in the sector, to improve strategic planning and defining conditions for activities in the energy sector. introduction of mechanisms for protection of endangered and protected energy customers. According to the explanation of the Federal Minister, the novelty is that this law includes provisions on the establishment of FERK, which are no longer in the Law on Electricity in FBiH, and that the law introduces a system of protection of end customers.
These are vulnerable customers from the category of households whose such status is determined on the basis of the state of social need and who are entitled to a subsidy of part of the costs for consumed electricity. Also, these are protected customers from the category of households whose such status is determined on the basis of the needs of protection of life and health, which is why they must not be disconnected from the electricity network.
It is also about improving the legal framework for regulating the performance of activities in the energy sector.
