Established law on the use of renewable energy sources

At today’s session in Mostar, the Government of the Federation of Bosnia and Herzegovina approved and sent to the Parliament of the Federation of Bosnia and Herzegovina the Draft Law on the Use of Renewable Energy Sources and Efficient Cogeneration (OIEiEK).
The aim of this law is to promote and regulate the production of electricity and heating and cooling energy from RES and EK, as well as the use of renewable energy sources (RES) in transport for consumption on the domestic market and to increase the share in total energy consumption, and to ensure the development of incentive measures, regulatory framework and technical infrastructure for OIEiEK.
Encouraging the production of electricity from RES and the production of heat and electricity in cogeneration (combined cycle), as well as the use of RES in transport, ensures, among other things, the realization of the electric power policy regarding the share of energy produced from RES and EK in the total energy consumption in FBiH, as and integration of RES into the power system. It also provides a contribution to environmental protection and the continuous development of the electricity market, as well as a reduction in dependence on the import of fossil fuels and their impact on the environment, as well as a favorable environment for domestic and foreign investors related to the safety of investments in the construction of RES and EK plants.
By using renewable energy sources, the goals of the Federation of Bosnia and Herzegovina established in its strategic and planning documents in the field of energy are realized, as well as support for the implementation of the obligations that Bosnia and Herzegovina undertook by signing and ratifying international agreements. Mandatory goals for the use of renewable energy sources (RES) will be established within the planning document for energy and climate of the FBiH.
The draft law establishes the types of plants according to technology and classification according to the power of the plant, the continuation of the work of the Operator for OIEiEK according to the provisions of the new law, guarantees of origin for electricity produced from OIEiEK, then technological quotas and the scope of auctions, as well as incentive measures for the use of RES, the auction procedure, as well as transparency and informing the public. Also, guaranteed purchase prices and premiums, purchase of electricity, production for own needs, renewable energy communities, connection to the grid and balancing, plant construction, administrative supervision, regulatory supervision and inspection, as well as penal, transitional and final provisions were established.
Kako je obrazloženo, više je razloga za izradu i donošenje novog zakona kojm će biti uređen novi sistem podsticaja za korštenje obnovljivih izvora energije u FBiH. Među njima su usklađivanje s pravnom stečevinom Evropske unije i Energetske zajednice, unapređenje pravnog okvira u sektoru obnovljivih izvora energije i preciznije definisanje prava, obaveza i odgovornosti svih učesnika u novom sistemu podsticaja, zatim unapređenje pravnog okvira za efikasno provođenje novog sistema podsticaja, uvođenje novog načina podsticanja putem FIT (za mala postrojenja) i FIP (za velika postrojenja) aukcija, kao i uvođenje novih kategorija učesnika koji koriste obnovljive izvore energije (prosumeri i zajednice obnovljive energije).
Federalno ministarstvo energije, rudarstva i industrije je u obrazloženju, također navelo, da se pri izradi ovog zakona rukovodilo najboljim međunarodnim praksama i relevantnim pravnim aktima EU, poštujući međunarodno preuzete obaveze BiH i odluke donesene u okviru Ugovora o uspostavi Energetske zajednice. Osim toga, imali su u vidu i druge zakone u BiH, te je predloženim tekstom osiguran visok stepen harmonizacije s pravnim okvirom Europske unije.
