FBiH Occupational Safety Law: Two new regulations entered into force

The Federal Ministry of Labor and Social Policy reminds that the Rulebook on the procedure for assigning workers to jobs with increased risk and on the procedure for previous and periodic medical examinations of workers who perform jobs with increased risk (“Official Gazette of the Federation of BiH”, number: 9/23) and the Rulebook on on the content and method of submission on work injuries and occupational diseases (“Official Gazette of the Federation of Bosnia and Herzegovina”, number: 9/23) entered into force and, in this regard, the Ministry made them available on the Ministry’s website.

The regulations are dated 08.02.2023. published in the Official Gazette of the Federation of Bosnia and Herzegovina.

They said that the aforementioned regulations prescribe certain forms of forms which are also published on the Ministry’s website and which employers are obliged to comply with.

We will highlight the most significant innovations brought by Rulebook 1 and Rulebook 2:

The new form and content of the Report on work-related injury and occupational disease, as well as the obligations of the employer and the worker in the aforementioned situations, are determined as an integral part of Rulebook 1;
Rulebook 2 defines jobs and working conditions, as well as assigning workers to jobs with increased risk;
The general and specific elements of previous and periodic medical examinations are prescribed, contained according to the programs from annexes II and III, as integral parts of Rulebook 2;
New Forms have been prescribed for the procedure of previous and periodic medical examinations for workers who perform tasks with increased risk*.
*Reports on previous and periodic medical examinations, issued in accordance with the Rulebook on conditions for determining workplaces with special working conditions and medical examinations of workers in those positions (“Official Gazette of SRBiH”, No. 2/91), remain in force until the occurrence of the obligation to perform a new periodical medical examination, counting according to the deadlines established in Annex III from Article 11, paragraph (2) of this Rulebook.

The regulations entered into force on February 9, 2023. year, from when the application of previously valid regulations regulating the same matter, which were in force since 1991, ceases.

Let us remind you that at the session of the House of Peoples on October 1, 2020, the new Law on Occupational Safety of the FBiH was adopted. The law entered into force on November 7, 2020, and was published in the Official Gazette of FBiH no. 79/20.

It is a reform law that is harmonized with international documents, ie the directive itself. The law prescribes obligations for all employers, both for those from the real sector and for employers from the public sector.

The law applies to all those institutions that are regulated by the law on the work of BiH institutions, which includes associations and foundations, because there is no law at the state level. Armed forces and police officers are also obliged to apply the Law, until a special regulation is adopted for them.

One of the obligations of the employers was the preparation of the internal Regulations on occupational safety and the adoption of the Act on risk assessment.
